Contest Official Terms ⋆ Felipe Femur & Friends

ELIGIBILITY: FELIPE FEMUR, LLC. (referred to herein as “SPONSOR”) IS THE SPONSOR OF THESE CONTESTS. THESE CONTESTS ARE OPEN TO ENTRANTS WORLDWIDE. By submitting an email with piece of fan art, whether submitted by entrant or one of Entrant’s parents or legal guardians if under the age of eighteen (18) or age of consent in Entrant’s country of origin by time of submission, Entrant confirms that they have read, understood, and agree to these Contest(s) rules, and that such agreement constitutes acceptance of these Contest(s) rules on behalf of Entrant. Directors, officers and employees of Sponsor, its parent, and any of their respective affiliate companies, subsidiaries, agents, professional advisers, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. There is no cost to enter or win. Offer void where prohibited. In the event of any dispute, entries will be deemed to have been submitted by the owner of the e-mail address from which the e-mail was sent.
DISCLAIMER: Sponsor, all participating sponsors, as well as any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisers, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, internet, or other computer or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Contest(s).
CONTEST(S) PERIOD: The Contest(s) shall commence on 12:01 PM PST April 09, 2016, and shall continue in duration until 12:01 AM PST October 31, 2016 (the “Deadline”). All entries must be received by the Deadline to be eligible to win a prize.
PRIZES: First Place Winner of Felipe Femur Fan Art contest. One (1) qualified entrant will be chosen by Sponsor as the “First Place Winner,” of the Felipe Femur Fan Art and will receive a prize package consisting of one (1) gift card to Toy “R” Us, with an exact retail value of $50.00. First Place Winner of Monster Maker: Design Your Own Monster contest. One (1) qualified entrant will be chosen by Sponsor as the “First Place Winner,” of the Monster Maker: Design Your Own Monster contest to receive a prize package consisting of one (1) gift card to Toy “R” Us, with an exact retail value of $50.00, and one (1) transformation of their art into a Felipe Femur Universe character with a bio page. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. All prizes will be awarded. Prizes returned as undeliverable or otherwise not claimed within fifteen (15) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address. All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
HOW TO ENTER: Submit your name and artwork based on Sponsor’s characters to: fanart@felipefemur.com. Each submission shall be a high resolution JPEG, PNG, or in DOC, or RTF format and the file of no more than 5MB in size.
CONTEST(S) RULES: Sponsor shall choose the winners from all entrants who have submitted an entry prior to the deadline. Winners shall be chosen by Sponsor at its sole discretion based upon which entrants display the best overall impression of the art and quality of the artistic expression and overall design for the Felipe Femur Fan Art contest that is based on the Felipe Femur characters; or in the Monster Maker: Design Your Own Monster contest that which demonstrates the most creativity or originality for the depicted theme of a monster, as well as the aforementioned criteria for artistic composition. The decision of Sponsor is final. Prize winners will be notified by e-mail within thirty (30) days thereafter. To claim a prize, winners should follow the instructions contained in their notification.
LICENSE: By entering your Submission in the Felipe Femur Fan Art contest and/or the Monster Maker: Design Your Own Monster contest, you hereby grant Sponsor and its successors a worldwide, perpetual, non-exclusive, irrevocable, royalty-free, sublicenseable (through multiple tiers) and transferable license (with a right to create derivative works) to use, copy, distribute, perform, publicly perform and display your Submission, in any and all media, in whatever form, for any legal purposes whatsoever now known or hereinafter becomes known Without limiting the generality of the foregoing, you acknowledge that Sponsor shall have the right to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and non-commercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to you or any other person or entity. You also grant each user of the and the website a non-exclusive license to access your Submission through the Website and to use, copy, distribute, perform, publicly perform, create derivative works of, and display your submission as allowed by the Website and in accordance with all official policies, rules, regulations, terms of use and/or guidelines of the Felipe Femur website. Each entrant irrevocably waives any and all so-called moral rights they may have in the Submission(s) submitted by him or her.
ORIGINAL WORK OF AUTHORSHIP: For the Monster Maker: Design Your Own Monster contest you hereby warrant and represent that (a) you own all rights to all Entry Materials submitted by you; and (b) all such Entry Materials are original works of authorship on your part and have not been copied, in whole or in part, from any other work and do not violate, misappropriate or infringe any copyright, trademark or other proprietary right of any other person or entity. For the Felipe Femur Fan Art contest you hereby warrant and represent that (a)you own all rights to Entry Material that is not property of Felipe Femur, LLC.; and (b) all such Entry Materials are original works of authorship on your part and have not been copied, in whole or in part, from any other work outside of Felipe Femur and do not violate, misappropriate or infringe any copyright, trademark or other proprietary right of any other person or entity.
COLLECTION OF INFORMATION: By entering the Monster Maker: Design Your Own Monster and/or Felipe Femur Fan Art contest you consent to Sponsor’s use of this information (your name and email) to inform you of possible prizes, and to publish your work with your first name above it on the Felipe Femur website (www.felipefemur.com).
GENERAL RELEASE: By entering the Monster Maker: Design Your Own Monster and/or Felipe Femur Fan Art contest, you release Sponsor, participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the “Released Parties”) from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the contest(s) or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
AFFIDAVIT & RELEASE: As a condition of being awarded any prize, winners will be required to execute and deliver to Sponsor a signed Affidavit of Eligibility, which includes an acceptance of these Official Rules and a release of liability.
WINNERS LIST: Winners’ names will be available online at after November 3rd 2016.
RIGHT TO CANCEL OR SUSPEND CONTEST(S): If for any reason the Contest(s) is not capable of running as planned, due to a major force event, the organizers reserve the right to cancel, terminate, modify, or suspend the Contest(s).
MISCELLANEOUS: The Contest(s) and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Contest(s) or any entrant’s participation in the Contest(s) should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest(s) as planned. Entrants who violate these Official Rules, tamper with the operation of the contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest(s) or any other entrant (in each case as determined in Sponsor’s sole discretion) are subject to disqualification from entry into the Contest(s). Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest(s).
